We keep collection to what we actually need. Depending on how you interact with us, this may include:
When delivering services we may process personal information contained in a client's operational data — for example the identity of the person who logged an inspection. In those cases the client is generally the responsible party and we act as an operator on their instruction. This is described in our Data Protection Notice.
POPIA requires a lawful justification for processing. Ours are set out below.
| Purpose | Justification under POPIA |
|---|---|
| Responding to your enquiry and arranging a discovery call | Steps to conclude or perform a contract, and our legitimate interests in responding to approaches |
| Providing and supporting our services | Performance of a contract |
| Keeping records required for accounting, tax and governance | Compliance with a legal obligation |
| Securing and maintaining this website | Our legitimate interests in operating a secure service |
| Sending occasional updates about our services, where you have asked for them | Your consent, which you may withdraw at any time |
We do not sell personal information, and we do not use it for automated decision-making that produces legal consequences for you.
We share personal information only where there is a reason to. That may include:
We do not sell, rent or trade personal information to third parties for their own marketing.
Some of our service providers may store or process information outside South Africa. Where that happens, we transfer personal information only in the circumstances permitted by section 72 of POPIA — namely where the recipient is subject to a law, binding corporate rules or a binding agreement providing an adequate level of protection, where you have consented, or where the transfer is necessary to perform a contract with you.
We keep personal information only for as long as it serves the purpose it was collected for, or as long as the law requires.
| Category | Typical retention |
|---|---|
| Enquiries that do not proceed | Up to 24 months, then deleted |
| Client engagement records | Duration of the engagement plus the period required by law |
| Accounting and tax records | As prescribed by South African tax and companies legislation |
| Website server logs | Short-term, as retained by our hosting provider |
As required by section 19 of POPIA, we maintain appropriate, reasonable technical and organisational measures to safeguard personal information against loss, damage and unlawful access. These include role-based access control, encryption of data in transit, restricted administrative access, logging of system activity, vetting of service providers, and internal procedures for reporting suspected incidents.
No system can be guaranteed entirely secure. If a security compromise affecting your personal information occurs, we will notify you and the Information Regulator as required by section 22 of POPIA.
Under POPIA you have the right to:
To exercise any of these, contact our Information Officer at info@mokaygroup.co.za. We may ask you to verify your identity before we act. We will respond within a reasonable period, and in any event within the timeframes POPIA prescribes. A request for access may be made using the prescribed form under the Promotion of Access to Information Act 2 of 2000 (PAIA).
If you believe we have not handled your personal information lawfully, we would prefer you raise it with us first so we can put it right. You are, however, entitled to complain directly to the Information Regulator (South Africa) at any time. The Regulator's current contact details and complaint forms are published at inforegulator.org.za.
We may update this policy as our services, systems or legal obligations change. The date at the top of this page reflects the most recent revision. Material changes will be brought to your attention where practicable.
Questions about this policy or about how we handle personal information can be sent to our Information Officer:
